FMCSA Declares Regional Emergency Regarding Fuel
Notice: As of May 11th the FMCSA has added West Virginia to the list of affected states.
Colonial Pipeline owns over 5,500 miles of pipe from Texas to New York. It was the victim of a malware attack starting on May 7th, 2021. In response, Colonial Pipeline has shut down its system, which transferred 100 million gallons of petroleum products daily. In response to the impending shortage of different forms of fuel, the FMCSA has declared a Regional Emergency exemption for those hauling these products to the affected areas.

The emergency declaration can be read on the FMCSA website. It emphasizes that it only applies to drivers delivering “gasoline, diesel, jet fuel, and other refined petroleum products” to these areas:
- Alabama
- Arkansas
- District of Columbia
- Delaware
- Florida
- Georgia
- Kentucky
- Louisiana
- Maryland
- Mississippi
- New Jersey
- New York
- North Carolina
- Pennsylvania
- South Carolina
- Tennessee
- Texas
- Virginia
- West Viriginia
The FMCSA is temporarily suspending hours-of-service regulations for these haulers. It ends either when the Regional Emergency ends, or June 8th, whichever is sooner.
Conclusion
As with all of the other states of emergencies in which the FMCSA suspends hours-of-service, the standard rules apply. A driver that has worked beyond the standard driving hours must take an extended break once the delivery is done. They must also follow all other rules of the road such as speed limits and traffic lights.
