EPA Proposes End to DEF Derating
A phrase you have likely never heard in the trucking industry until now, and will likely never hear in earnest is, “I love DEF derating!” The basic concept is simple: when a pollution aspect of the truck does not operate as well as it should, the truck intentionally limits its power until the problem is resolved. The Environmental Protection Agency (EPA) knows how much of a drag this regulation is, so the Trump Administration’s EPA is considering putting a stop to it.

The news comes from a Notice of Proposed Rulemaking that covers Biden-era regulations about useful lives and warranties of trucks, but also about diesel exhaust fluid systems and how they derate trucks, hoping to instead give the driver a warning light similar to a check engine sign but otherwise operating like normal.
“Americans depend on reliable trucks to move essential goods across the country. If finalized, these changes will help manufacturers keep improving their vehicles without being forced to rush products to market before they’re ready,” said EPA Administrator Lee Zeldin. “Combined with the Trump EPA’s first proposed deregulatory action to address ongoing DEF problems, this will ease real burdens for operators.”
The EPA proposal is estimated “to save up to $37 billion in emission-related warranty savings, including up to $6,000 per diesel vehicle from the warranty savings alone.”

However, these regulatory rollbacks do not come without a drawback. One of the Biden-era rules that is being slashed to reduce costs is the one regarding extended warranties and useful lives being extended by 350,000 miles and 215,000 miles respectively. Though this regulation extending the lives of trucks had an estimated cost of $20,000 in additional regulations, it is a small price to pay for effectively doubling the lifetime of the asset. We will have to wait and see what this regulatory rollback has on the trucking industry, especially in an era where the average truck age is higher than ever and people are holding onto their equipment until the very last minute. In a way, however, it may actually benefit the environment, as replacing old trucks with newer trucks tends to result in less pollution.
