FMCSA to Remove Obsolete Regulations
If you ever take the time to look up crazy laws (such as it being illegal to eat an orange in the bathtub in California), the most common cause of it is that it was established well over a century and never taken off the books while still being enforced. When it comes to the Federal Motor Carrier Safety Administration (FMCSA), however, they often enforce old regulations while they are still on the books. In an effort to reduce regulations that have next to no impact on safety, the FMCSA for Trump’s second term is looking to cut old rules.
Details
Since a post in the Federal Register on April 3rd, 2025, the Department of Transportation (and by extension the FMCSA) has been working to reduce regulations where the burden does not pay dividends in terms of safety. Examples include:
- A requirement that rear guards be properly labeled, considering the labels often become illegible due to regular wear-and-tear.
- A requirement that truck tractors must have working rear lamps even when towing a trailer, wherein nobody can see them.
- Removal of rules regarding liquid-burning flares, as they have gone the way of the dodo bird.
- The FMCSA now allows auxiliary fuel tanks to use gravity and siphon feeds provided that the tanks are 5 gallons or less and only used when the vehicle is not moving.
Conclusion
With the FMCSA trying to perform a balancing act of removing undue or pointless regulations while also maintaining regulations that provide a higher level of safety on the road, it raises the question as to what potential rules may be altered from the books next.
