FMCSA Removes More Regulations
In President Donald Trump’s first term, he had a policy for the Executive Branch: for every regulation added, two must be removed. In his second term, he has ramped this up tremendously, making it so that federal entities must remove ten regulations for every new one added. One such entity, under the federal Department of Transportation is the Federal Motor Carrier Safety Administration (FMCSA), and they have a few more changes they are implementing.
Tired of Tires
The FMCSA is revising Section 396.3(b)(1), which involves records for each vehicle, to no longer require the listing of tire sizes. The FMCSA says that proper tire size fittings are already enforced enough through mandatory DOT inspections happening yearly as well as roadside inspections, making the requirement to list tire sizes for every truck redundant. Other aspects of the Section, including serial number and model year of the truck, still remain.
A Disgusting Vehicle Weight
To simplify paperwork, the FMCSA has declared that any vehicle with a Gross Vehicle Weight Rating (GVWR) of 10,001 pounds or more, used in interstate commerce, is a Commercial Motor Vehicle. This is to close a potential loophole a driver may try to claim if they are driving an established Commercial Motor Vehicle while it is empty and below the GVWR, which measures the highest weight a vehicle is graded at to operate safely. This is not to say that all vehicles with a GVWR over 10,000 pounds, such as a motor home, are inherently Commercial Motor Vehicles, but rather that changing CMV status from on to off is not as simple as unloading.
Filing a Complaint
Requesting a potential deregulation is now easier than ever. While at the time of writing the change has not been made yet, soon any fleet operator with standing (meaning the regulation impacts them) can argue their case for changes to a federal regulation at Regulations.gov under federal docket FMCSA-2021-0054, which is much faster than other methods such as lawsuits.
Conclusion
This is but a small list of regulatory changes, and therefore does not meet President Trump’s “10-for-1” ratio needed to enact a new regulation, but it does get them 30% closer to enacting a new one.
