PRIVACY Act to Limit Flock Cameras
If you have been paying attention on the Internet as of late, you may have heard of the term “Flock cameras”. Flock Safety is a business that specializes in security and surveillance hardware. With Flock saying that it reads billions of license plates every month through its cameras, some members of Congress are worried that this can be a violation of privacy, including for truck drivers. To that end, the House of Representatives has introduced the Protecting Rights in Video and Equipment Acquired Discovery (PRIVACY) Act. Do not ask us how that name becomes that acronym.

“Americans’ Fourth Amendment right to be secure in their privacy does not disappear just because of new technology or artificial intelligence,” said Keith Self, a representative from Texas who introduced the Bill. “Americans have a constitutional right to be secure in their persons, houses, papers, and effects, and our government is supposed to get a warrant before invading that privacy. This bill simply restores that protection. Get a warrant.” With billions of scans done by companies such as Flock Safety every single month, a good percentage of them are likely to be commercial vehicles, and as such this affects truckers just as much as it does a minivan moving kids to soccer practice.
According to the press release from Keith Self, the PRIVACY Act would:
- Create a list of intrusive technologies and require federal law enforcement to obtain a warrant before accessing or querying data from those systems.
- Limit retention of data obtained under a warrant to 30 days, unless the data constitutes evidence in a prosecution or a court grants a limited extension.
- Prohibit the use of federal funds to purchase or install such intrusive technologies, with narrow exceptions.
Conclusion
As with all things introduced into Congress, it faces an uphill battle to become law. It needs approval from the House, the Senate, and the presidency to become an official requirement, and lobbyists from various businesses that make security cameras may take umbridge with the Bill (Flock is just one company of many, there are others such as Axion that make similar security cameras). With these cameras becoming more and more prevalent across the country, along with other technologies, the federal government is constantly embroiled in a game of cat-and-mouse in regulating new and stronger technologies as they develop.
