CARB Abandons Advanced Clean Fleet Rule Altogether
The California Air Resources Board (CARB) has given up on the Advanced Clean Fleet (ACF) rule in its entirety, after a recent lawsuit.

The recent lawsuit, referred to as Nebraska v. CliffBonta for the last names of the two defendants, Steven Cliff (CARB Executive Officer) and Rob Bonta (California Attorney General), has left the state government in a bit of a daze. In an official statement, the two defendants stated California, “will not enforce the part of the Advanced Clean Fleets regulation requiring 100% zero-emission-vehicle [ZEV] sales in the medium- and heavy-duty categories beginning with model year 2036” and “will not take any enforcement action” around the rule.
If you have paid any attention to the trucking industry for the past four years, you have likely heard of the ACF regulation, and its two biggest points: outlawing sales of internal combustion engines in California by 2036, and making it unlawful to drive a diesel engine in state lines by 2042.
A coalition of states have sued California and CARB for its rambunctious plans, stating that they had standing because truckers from the other states may invariably find themselves traveling to California to either pick up or drop off a delivery. This coalition of states included:
- Alabama
- Arkansas
- Georgia
- Idaho
- Indiana
- Iowa
- Kansas
- Louisiana
- Missouri
- Montana
- Nebraska
- Oklahoma
- South Carolina
- Utah
- West Virginia
- Wyoming.
Nebraska Attorney General Mike Hilgers declared this changing of directions to be a triumphant victory, stating in an interview, “I am grateful for the strong coalition of sister states who joined our fight against this radical mandate.”
Conclusion
While there is now no longer a slow but impending deadline for diesel engines and its fuel within the state of California, market forces still reign supreme. If alternative energy sources such as electricity and hydrogen power can increase their economic efficiency, it is still very much possible that diesel engines will eventually be phased out by 2042. After all, at the time of writing that is still 17 years away, and a lot can happen in 17 years: just 17 years ago from today the iPhone was entering the market and completely revolutionized modern technology as we know it today with the advent of the smartphone. All of this is to say that alternative energy is not out of the race just yet, it simply does not have the same overwhelming, crushing weight of California regulations standing behind it as it did before.
