Julie Su Nominated as Secretary of Labor Again
History does not repeat itself, but it often rhymes. That is what is happening right now with the case of Julie Su, and how she is once again going through the nomination process to become the Secretary of Labor.

The previous attempt to nominate her did not go through as it was met with a lack of support from members of Congress due to how unpopular she was with their constituents. This includes truckers.
Before working as the acting secretary for the Department of Labor, Julie Su worked as secretary for the California Labor and Workforce Development Agency and helped get AB-5 passed. While it was originally intended to curb the “gig economy” of the likes of DoorDash and Uber, its wording, combined with a ballot proposition that passed that provided immunity for the original targets of the law, has made it a trucking industry regulatory staple.
Her renomination was met with similar outcry.
“As we’ve communicated to the White House and the U.S. Senate since her nomination was first announced, Julie Su’s record of opposition to independent truckers in California should not be rewarded with a promotion,” said Todd Spencer, OOIDA president, who had voiced similar disdain in June 2023.
“No matter how many times she’s renominated, Julie Su’s record remains a huge red flag for our industry and any senator concerned about radical policies from California becoming federal law,” said ATA President and CEO Chris Spear.
Conclusion
The greatest fear that trucking industry stakeholders have is that she, should she become the Secretary of Labor, will implement a nationwide “AB-5” law that would reclassify owner-operators driving under the Authority of another motor carrier as employees.
One interesting question to ask is if she is nominated, whether or not she will have enough time for a national “AB-5” to hit the books. Ultimately, this depends on the outcome of the 2024 election. Combine this with the fact that it is unlikely she will not pass the nomination process (the United States Senate has hardly changed in the past 8 months), and for the time being truckers have little to fear, but should instead watch with caution.
