States Split on CARB Regulations
Being the most populous state in the nation, California is often said to be the focal point of many trends, and that what goes for California eventually goes for the rest of the country. To that end, the California Air Resources Board potentially has a lot of power when it comes to dictating the trucking industry not just within its borders, but up to all fifty states. When it comes to CARB regulations, there are two sides: states that hope to adopt similar regulations, and those that are starting a lawsuit.

A coalition of 17 different states has filed a petition for review in the U.S. District Court for the Eastern District of California that hopes to prevent CARB’s Advanced Clean Fleets rule from becoming reality. The states that are fighting back in one way or another by joining this lawsuit are:

- Arkansas
- Arizona
- Georgia
- Idaho
- Indiana
- Iowa
- Kansas
- Louisiana
- Missouri
- Montana
- Nebraska
- Oklahoma
- South Carolina
- Utah
- West Virginia
- Wyoming
Nebraska Attorney General Mike Hilgers says that the coalition has judicial standing because of the reverberating effect California will have on the rest of the nation. He says while also talking about a similar lawsuit against the EPA: “This effort — coming at a time of heightened inflation and with an already-strained electrical grid — will devastate the trucking and logistics industry, raise prices for customers, and impact untold number of jobs across Nebraska and the country. Neither California nor the EPA has the constitutional power to dictate these nationwide rules to Americans. I am proud to lead our efforts to stop these unconstitutional attempts to remake our economy and am grateful to our sister states for joining our coalitions.”
Conclusion
Currently the state count on the issue of eventually outlawing diesel trucks stands at 11 for and 17 against, so there are still 22 states that have yet to pick a side (with Connecticut considering the issue but not yet formally taking a side for or against). As with most things going through the courts, it will likely be years before we see the conclusion of this story, but there is little need to rush: California’s diesel ban does go into effect until 2042.
