Government Regulators Delay Rulemakings to 2025
Truckers knowledgeable about industry regulations constantly hear about the harrowing future of speed limiters, but it seems like that can is constantly kicked down the road until before you know it, it is in another state. That seems to be the case nowadays, as speed limiters are one of the regulations being tabled until 2025.
Details
The National Highway Traffic and Safety Administration (NHTSA) and Federal Motor Carrier Safety Administration (FMCSA) have been working together for years on numerous regulations that would impact the trucking industry, namely, speed limiters and automatic emergency braking (AEB). The two agencies have said that they are pushing the dates for publishing rules regarding those technologies until 2025: AEBs in January, and speed limiters in May. That gives five and ten months respectively from the time of publishing.
The decision to delay these rulemakings has been met with disapproval from safety groups, stating that the AEB rule is a “highly consequential rulemaking mandated by the Infrastructure Investment and Jobs Act to have been completed within two years,” in a strongly worded letter. While public comments have mostly been positive, truckers have also worried about the implications of such a technology, such as the AEB system activating at 60 MPH due to a false positive.
Conclusion
Officially, both the FMCSA and NHTSA have not stated a reason for these delays.
If we had to fancy a guess for the delay (and this is strictly conjecture), we think it has to do with the fact that it is an election year, coupled with Joe Biden’s announcement that he would not be seeking a second term. Regardless of which party wins the 2024 election, there is going to be a new leader of the executive branch, and likely the NHTSA and FMCSA do not want to put the work in to establish regulations with one party saying they went too far and the other saying they did not go far enough.
Whatever the case, truckers who hate the prospect of these technological limitations on their trucks have won another five months minimum of not having to worry about it.
