FMCSA Extends Emergency Declaration in Eight States
Is it just us, or is this winter colder than most? The Federal Motor Carrier Safety Administration (FMCSA) seems to agree, as it is extending a State of Emergency for eight states in the hauling of various fuels.

The first Declaration was in direct response to the Suncor refinery in Colorado having an unexpected shutdown, leading to a lower supply of fuel for the region. This started in mid-January and was expected to end come February 15th, but the refinery is still inoperable, meaning the need for fuels such as jet fuel, gasoline, and diesel is still prominent. As such, FMCSA Administrator Robin Hutcheson has authorized an extension to the Declaration, and it will now be running until March 17th.
The eight states that drivers hauling various fuels for that enables the driver to bypass typical hours-of-service regulations are:
- Colorado
- Kansas
- Nebraska
- New Mexico
- Oklahoma
- Texas
- Wyoming
The standard rules for these exemptions during a State of Emergency apply: drivers going beyond the standard hours must take a ten-hour break, and no other regulatory relief other than what is directly said in the Declaration applies, including but not limited to oversize hauling regulations. Additionally, the Declaration mentions that no deliveries regarding infrastructure repair are protected under it.
Conclusion
Will the Declaration be extended again? This is highly unlikely, as it will expire in the middle of March, and by then experts predict that it will start to heat up, decreasing demand. Additionally, by then the Suncor refinery will once again open, generating supply. These two factors should cause everything to go back to normal by the end of this extension.
With February coming to an end, it marks not only the ending of winter, but also the slow season for trucking. We are looking forward to the end of the slow season of 2023; we predict that this year is going to be a huge one for trucking.
