EPA Admin Submits Regulatory Rollbacks
Lee Zeldin, Administrator of the Environmental Protection Agency (EPA), has submitted waivers to pull back California’s approval for the Advanced Clean Truck and Omnibus NOx regulations that were established under the Biden Administration. How does submitting waivers to Congress actually stop those regulations rather than hurt it? Well, it is complicated.

We have covered both of these regulations before, especially the Advanced Clean Truck regulation and how it would slowly build up the required number of sales of zero-emission trucks in the state of California, capping off in 2042 with outlawing the driving of diesel vehicles within state borders.
Usually, the EPA would send Congress waivers granted to states to review, but Zeldin’s office notes that President Biden sidestepped this action, allowing California to slowly implement those regulations without congressional review. Zeldin is now submitting those exact waivers to the current Congress to have them vote on whether to approve or disapprove them.
Naturally, given the party composition of both wings of the legislative branch, Zeldin is expecting them to be disapproved, which he is in support of because of its implications on the cost of future trucks and the increased costs of goods delivered on those trucks being passed on to the consumers in an already red-hot economy.
The decision was met with support from key trucking industry representatives. “This is not the United States of California. California should never be given the keys to set national policy and regulate America’s supply chain,” said American Trucking Associations President and CEO Chris Spear. “Thanks to the leadership of the Trump Administration, Congress now has one more avenue available to reclaim the keys from Sacramento and restore common sense to our nation’s environmental policies.“

While the California Air Resources Board (CARB) has already made the decision to abandon the Advanced Clean Truck Regulation, the Omnibus NOx regulation, designed with model years 2027 and beyond in mind and targeting a reduction of approximately 90% of these emissions, is still on the table. Likely, Congress will express its disapproval and the EPA will then rescind its waivers with congressional support, but considering how the Biden Administration sidestepped Congress the first time, it is fully possible that the Trump Administration will do the same.
