California Abandons Advanced Clean Fleets Rule
Unless you have been living under a rock for the past two years, you have heard about the California Air Resource Board (CARB) and their strong plans to make the trucking industry greener. No new diesel trucks by 2036. Illegal to operate a diesel truck by 2042. Well, drivers in or traveling through the Golden State can now rest easier, as CARB has decided to abandon these plans.
Details
CARB was petitioning the president for waivers that would enable it to implement such strict regulations, but realizes that even if Biden were to grant them in the final hours of his presidency, Donald Trump would revoke them.
“While we are disappointed that U.S. EPA was unable to act on all the requests in time, the withdrawal is an important step given the uncertainty presented by the incoming administration that previously attacked California’s programs to protect public health and the climate and has said will continue to oppose those programs,” California Air Resources Board Chair Liane Randolph said in a statement regarding the withdrawal of the petition.
What makes this case so interesting is that if it were beholden to the whims of the president at any given time, then that means for it to fully be set into motion, a president supporting them would have had to win five times in a row, lest someone in opposition repeal it day one of their term.
Conclusion
The same can be said in the opposite direction, however, and should the winner of 2028 be in favor of stringent air control, the program may be set into place yet again, likely with a later deadline than 2042. Despite the battle continuing to rage on, the 47th president is likely to give the trucking industry four years of clemency.
“We welcome this update and look forward to working with the new administration on common sense environmental policies that allow small business truckers to remain viable and not forced out of business in the regulatory juggernaut,” Todd Spencer, President of Owner-Operator Independent Drivers Association said in his own statement regarding the CARB withdrawal.
