Emergency Declaration Waivers for Hurricane Lee
More hurricane news! This time, the hurricane is hitting the northeast, and some states are already declaring emergencies to be ahead of the curve, before Lee hits land as a category five hurricane.
Maine
Maine’s State of Emergency Declaration, which you can read on the relevant FMCSA webpage, does not directly pertain to truckers. Instead, it is a very general Declaration, requiring state departments and agencies to cooperate with the Maine Emergency Management Agency. This means that we may see some exemptions from the Maine Department of Transportation soon enough. Additionally, the state may have an increased need for the delivery of relief goods such as blankets and clothing.
Massachusetts
The state of Massachusetts’ Declaration is very similar to that of Maine’s while it does not outline any direct waivers for truckers, it lists “use of the state’s resources, as well as the deployment of federal and interstate resources, if required, and provide necessary assistance in emergency response and recovery efforts…”

Conclusion
Both Declarations have no set time limit, and are set to expire by governor’s order that the State of the Emergency no longer exists. Depending on the extent of the damage, that could be months, though we hope that it will not come to levels of damage that rival Hurricane Katrina back in 2005.
Though the weather is starting to cool down as the nation enters fall, we are not quite out of hurricane season yet, which is set to end on November 30th. This means that even after Hilary, Idalia and Lee, there will still be a little over two more months where hurricanes have a chance of occurring. The United States will need its determined and dedicated truckers in order to provide relief wherever it is needed most.
The only question that remains is whether or not other states in the Northeast will follow suit and post their own Declarations. If they do, we will be sure to let you know.
