California Issues State of Emergency for Torrential Rain
Loyal readers may remember what we had written about in the past, how California was experiencing intense drought and how the federal government may want to install a pipeline that can distribute water from where it is flooding to where it is dry. That will not be needed anymore. California is experiencing intense downpour to the point where it is getting problematic.

TopMark Funding is headquartered in California, and we can confirm that it is currently quite the spectacle. As such, Governor Gavin Newsom has issued a State of Emergency that suspends specific regulations in trucking to help with emergency relief.

- The California Department of Transportation (CDOT) will work with the Federal Highway Administration’s Emergency Relief Program to obtain the means for highway repairs.
- Drivers may drive beyond the standard hours-of-service window, provided they are delivering fuels directly related to the State of Emergency and follow the typical suspension rules (a ten hour break after delivery or feeling fatigued).
- Out-of-state motor carriers providing assistance are not required to have a motor carrier permit nor pay certain fees related to doing business within California.
- Competitive bidding requirements for state contracts, which would likely include the delivery of relief supplies to emergency shelters, are temporarily shelved in favor of faster resolution.
Conclusion
The Declaration is expected to stay in force until either February 3rd or until the intense weather patterns have ended, whichever is sooner.
The Declaration does not say anything regarding the suspension of the latest California Air Resources Board regulation regarding engines from before 2010, so truckers who intend to help with providing relief from the storm but have an older vehicle will find themselves out of luck.
As terrible as the side effects are of this storm, the intense rain California has been experiencing has been necessary considering the drought the state has seen since the last period of flooding in early 2017. We only lament that six years of rain had to happen in a single month.
