California Highway Patrol Lagging on English Enforcement
It seems like the battle between state and federal government will never end, it is just a question as to which state is battling the United States government. When Biden was in office, it tended to be Texas, and now with Trump back in the driver’s seat, it is California. The latest and greatest debacle in the federal-versus-state saga is the English Language Proficiency (ELP) rule that has been reinstated federally, where California Highway Patrol (CHP) pretty much says they just are not going to enforce it.

Data from the federal government says that Texas has issued approximately 1,850 ELP violations in the last month, compared to just 80 in California. Considering the population of California is about 25% larger, you would expect the numbers to at least be closer together, even when accounting for the sheer amount of border Texas shares with Mexico compared to California.
A representative for the CHP says it “has not implemented any enforcement changes in response to recent federal guidance requiring commercial drivers to speak English, as it is not part of California law,” but this decision to fly in direct opposition to the federal government can have some implications and consequences.
For instance, the Commercial Vehicle Safety Alliance says that the federal government may choose to withhold infrastructure funding in direct retaliation to California refusing to play ball. Considering the Golden State received $30 million in grant funding last year, this could have an effect on the state’s infrastructure.
Conclusion
Pennsylvania is also currently ignoring the federal order, but a spokesperson for their state police says that it is because of a technicality, “anytime there is a modification to any Federal statute, regulation, standard, or criteria that Pennsylvania has adopted, the modification cannot be applied in Pennsylvania until 60 days after the federal effective date,” meaning that Pennsylvania plans to implement it sometime near the end of August. California, in contrast, appears to be doing it in direct defiance of President Trump. It will be interesting to see how this all unfolds in the upcoming months.
