Anti-Speed Limiter Bill Introduced to Congress
When it comes to speed limiters, it is the same old song and dance. Regulators from the executive branch of the United States government want them, and industry stakeholders hate them. A new bill introduced into a Committee in Congress may cause the legislative branch to exert some power on its brother.
Details
The Deregulating Restrictions on Interstate Vehicles and Eighteen-Wheelers (DRIVE) Act has been introduced into the House Committee on Transportation and Infrastructure, where it would need to be approved before it could be voted upon in the House, then Senate, then signed across Joe Biden’s desk.
The Representative who introduced it, Josh Brecheen of Oklahoma, says that speed limiters will put an undue regulatory burden on both transportation and agricultural industries within the United States from the Federal Motor Carrier Safety Administration (FMCSA)..
The proposed Bill has been met with negative disposition from safety groups such as the Truck Safety Coalition and Road to Zero, who say that “arbitrarily stopping FMCSA from this rulemaking process would compromise the agency from pursuing its stated mission — to reduce large truck injuries and fatalities.” They also mention that speed limiter requirements have been delayed more than twenty times in the last decade.
Conclusion
The odds that this becomes law is about as likely as speed limiter regulations not being delayed again: very slim. A Republican introduced the DRIVE Act, and with the Republican Party holding a minimal majority in the House and only 49 seats in the Senate, it is unlikely it will reach Joe Biden’s desk, where he would likely veto it anyway.
The only thing that can really be done right now for those against speed limiters is to try to stand against the FMCSA itself, rather than circumvent them through Congress. Oftentimes, a notice for a new rule will be published in the Federal Register, where comments will be open to the public for sixty days. If you are in support or against speed limiters on trucks, this public comment section is the best chance that citizens have at getting their voices heard on the matter.
