Four Truck Manufacturers Go on Offensive Against CARB
It is another day in California, and that means somebody is suing somebody else. This time, however, it relates directly to the trucking industry, as four truck manufactures are shifting gears and standing against the California Air Resources Board (CARB).

By now you probably know the gist of what is happening: during the Biden Administration, CARB was all but given free reign to manage the Golden State’s transportation emission regulations, and with the change into the second Trump Administration, the standards set by Bidens’ Environmental Protection Agency was reversed. As such, four Original Equipment Manufacturers are saying that CARB no longer has any power over them. Those four truck manufacturers are:
- Daimler Truck North America.
- Volvo Group.
- PACCAR Inc.
- International Motors.
“The OEMs are in an impossible position,” according to the lawsuit. “On the one hand, California insists that plaintiff OEMs must follow CARB’s standards, including CARB’s truck and engine certification requirements, or be excluded from the California market, subjected to significant civil penalties, shut out of special considerations and flexibilities in future regulatory considerations, and excluded from state purchasing and incentive programs.”
“Plaintiffs are caught in the crossfire,” the lawsuit continues. “California demands that OEMs follow pre-empted laws; the United States maintains such laws are illegal and orders OEMs to disregard them. This situation is not tenable.”
Conclusion
As with other lawsuits that pertain to the trucking industry, the implications are wide-spreading. One strategy that has proven to become exceptionally popular is to delay a given case for as long as possible in hopes that the people in power have their terms end, and get replaced by people more favorable to their cause. While this is a route that CARB might choose to seek, it will be quite difficult to stall a case for 3.5 years in hopes of a new administration similar to Biden’s. Likely, they will have to pursue their defense the old-fashioned way, by arguing their case and having it go through the system, potentially up to the Supreme Court.
