FMCSA Revokes Five More ELDs
Once again, the Federal Motor Carrier Safety Administration (FMCSA) has issued a notice that they were removing Electronic Logging Devices (ELDs). This time, the count comes to five.
Details
The five ELDs in question are:
- Premium ELD. ELD Identifier: PMM492.
- True Logbook. ELD Identifier: TRL584.
- Xplore ELD. ELD Identifier: XPLORE.
- Kami ELD. ELD Identifier: KAM683.
- Evo ELD 1. ELD Identifier: G711H2.
They are being removed because, according to the FMCSA, the companies did not meet the minimum requirements established in Title 49 CFR Appendix A to Subpart B of Part 395. The section has thousands of words and approximately one hundred sections, so it is hard to pinpoint where each company went wrong. It can be read in its entirety at the Code of Federal Regulation’s website.
What this means for drivers is the usual song and dance. If you or a trucker under your wing is using one of these five ELDs, they are to cease immediately and to go to paper logs until they can secure a new, proper ELD. Should a driver continue to not have a proper ELD by December 15th, they are non-compliant and run the risk of being cited. The FMCSA specifically says:
“…safety officials are encouraged not to cite drivers using this revoked ELD for 395.8(a)(1) – “No record of duty status” or 395.22(a) – “Failing to use a registered ELD.” Instead, safety officials should request the driver’s paper logs, logging software, or use the ELD display as a back-up method to review the hours of service data.”
If you are driving with one of the revoked ELDs and are making the switch to paper logs, it may just make sense to keep the Declaration’s webpage in the back of your mind in the chance of an inspection.
Conclusion
We at TopMark Funding are glad that the FMCSA is now taking a proactive approach in notifying the world which ELDs are being revoked and must be replaced. Before, the FMCSA had a more lackadaisical approach, removing and adding ELDs off of the list of approved models and expecting the trucker and trucking company to just figure it out. Keeping this up (while hopefully not revoking too many ELDs as to make truckers disgruntled and confused) is a good way to implement trust in the federal regulators, that they have the best interests of drivers in mind and are not just arbitrarily flexing power.
