EPA to Block CARB Roadside Emission Checks
The war between federal and state governments continues, as the Environmental Protection Agency (EPA) and the California Air Resources Board (CARB) have a bit of a scuffle regarding emission checking devices.

CARB’s Heavy-Duty Inspection and Maintenance Program has them deploy roadside emission checkers to measure the toxic output of vehicles as they travel along the road, not unlike the speed checking devices you see on the road that ask you to slow down. Just like those devices, the machine checks traffic indiscriminately, regardless if the driver in question is from California, Virginia, or even Canada.
In an August 25th press release, the EPA announced its plans to fight the Heavy-Duty Inspection and Maintenance Program.
“California was not, and has never been, duly elected by the American people to run our great country,” said EPA Administrator Lee Zeldin in the news release. “The state’s power grab knows no bounds. EPA will not allow California to violate federal law, and we will not sit idly by while, in the name of climate change, they raise the cost of living on all Americans who rely on truck drivers and the products they deliver across the country.”
American Trucking Associations CEO Chris Spear, always with his finger on the pulse of the trucking industry, voiced his support.
“This is not the United States of California,” he said in a statement mirroring that of the EPA. “We appreciate Administrator Zeldin’s leadership to ensure California cannot dictate national policies that threaten our supply chain and the ability of America’s trucking industry to keep our nation’s goods moving.”
Conclusion
As with most battles between federal and state governments, this will again be battled in the courts for years, likely to the point past where Trump is no longer the United States President, where it may just die in court if the new Administration is of a different political affiliation. Such is the life of the battle between state and federal governments.
